Iraqi Ministry of Industry and Minerals Allocates New Opposition Period

BAGHDAD - Abu-Ghazaleh Intellectual Property (AGIP) Iraq Office has been informed by the Registrar Office that the Iraqi Ministry of Industry and Minerals has allocated the period from September 21 to December 21, 2005 as a new opposition period for all applicants who wish to file an opposition against the registration of trademarks published in the Official Gazette No. 454, advertisement No.1326 of May 30, 2005.
In addition, the Registrar told AGIP Iraq Office that certificates of registration will be issued after December 21, 2005.
The Iraqi Federation of Industries allocated the period from May 30, 2005 to August 30, 2005 for all clients who wanted to file an opposition against the registration of trademarks published in the Official Gazette No. 454. Consequently, certificates of registration were supposed to be issued after August 30, 2005.
However, due to the relocation of the Trademark Office from the Iraqi Federation of Industries to the Ministry of Industry and Minerals which took place in the period from May 30 to September 19, the aforementioned opposition period (May 30 to August 30) was not applicable.
According to the Iraqi Trademark Law, any interested party may file a written opposition against the registration of the trademark within 90 days as of the date of the last advertisement in the Official Gazette. In the absence of an opposition, a published trademark is registered, and the relevant certificate of registration is issued.
